RENTAL TERMS AND CONDITIONS CONTRACT

 

1.) Responsibility and Care of Rental Item(s):
Once rented, you are responsible for taking care of the Rental Items  and agree to treat each Rental Item with care and respect. You will be held responsible for any loss, destruction, or damage to the product beyond regular wear and tear (small stains, rips, missing beads or buttons, broken zippers, or any other minor damage covered by your $7 rental insurance). The Fitzroy reserves the right, using its sole and absolute discretion, to determine whether damages exceed the regular wear and tear allowance included in the rental insurance.
We require that you please keep all perfumes, make-up and tanning lotions away from the Rental Items, as these can leave permanent scents and staining. If your Rental Item is returned with perfume smells, indelible marks,  or spray tan stains, you may be charged for additional cleaning and care. 

2.) Alterations Policy:
NO alterations are permitted on Rental Items, including the use of temporary hem tape. Please do not alter the Rental Items. You will be liable for any seamstress fees to repair the alterations and to return the Rental Item to its original form.

3.) Dress Swaps:
Once you have made a booking you may switch to a different Rental Item up to your scheduled pick up or shipping date, pending the availability of your selected alternative item. If the Rental Item you switch to is of a higher value you will be required to pay any additional expenses related to the difference in rental price. If the Rental Item you are switching to is of a lesser value you will be issued a credit note to your Fitzroy online account for the difference. Swaps made within 48 hours of the rental start date/shipment date are rented ‘as-is’ and cannot be sent for additional cleaning in advance of delivery.

4.) Cancellations:You may cancel your booking for Store Credit at any time up to the first day of your rental term, or the day your dress leaves our studio with the shipping provider. Store Credits have no expiry and may be used towards any future rental with The Fitzroy. All rental bookings are non-refundable.

5.) Rental Period and Use:
Once you pick up or receive your Rental Item it is considered rented for the time period agreed upon. Unfortunately, if you choose not to wear the Rental Item, or if you return the Rental Item early, or if your event is cancelled, no Store Credit will be issued. 

6.) Condition of Rental Items:
Your Rental Item has been worn before and therefore, may not be in ‘new condition’. All items are thoroughly cleaned and checked over before each rental agreement, and our QA team do their best to rectify any issues, however some minor wear and tear or visible repairs on the garments remain beyond our control. As a sustainable company, we take pride in re-using these Rental Items and believe that any small imperfections represent the many magic moments the Rental Item has already experienced. We hope it will not impact your enjoyment of your Rental Item, but please note that The Fitzroy is not liable for minor wear and tear issues with Rental Items.

7.) Online Orders For Same-Day Pick-Ups: Online orders for same-day pick-up must be placed before noon, and the item(s) will be provided in "as-is" condition, without our standard quality control procedures. By placing a same-day pick-up order you acknowledge that the item(s) will be rented in as-is condition.

8.) Zippers and Boning:
All zippers are tested by our QA team to ensure they are fully functional. All boning is carefully assessed to ensure they are secure, enclosed and properly structured. Any unlikely zipper or boning malfunctions that may occur during your rental period are unfortunately beyond our control, and we cannot offer refunds due to zipper or boning issues.

9.) Event Cross-checking:
Rental Item(s) are reserved on a first-come, first-served basis, and your payment secures your Rental Item for your selected dates. As a courtesy, we make every effort to cross-check if two (2) or more, or the same Rental Items are going to the same event; however, this cannot be guaranteed. 
The Fitzroy reserves the right to refuse or cancel your order if we know that the Rental Item has already been booked by another customer for the same event. Please provide as much event information (event date, venue, name of event etc.) as possible to assist with cross-checking. 

10.) Return Cleaning:
Please do not take the Rental Item(s) to the dry cleaner. Dry cleaning upon return is included in the rental cost and will be handled by The Fitzroy. Simply return the Rental Item to our studio or via the pre-paid shipping method provided, and we will take care of the rest of the cleaning process.

11.) Late Returns:
Late returns of Rental Items are subject to a late fee of $30 per item, per day (+tax where applicable) and this policy is strictly enforced, no exceptions. Rental Items being shipped back to us will only be subject to late fees if postmarked after the agreed-upon return date and will not be charged late fees due to carrier delays. Late fees will be automatically charged to the credit card on file.

12.) Non-Return Policy:
Non-returns on Rental Items will be regarded as theft and charged at the full retail value of such Rental Item(s) as posted on our website,  in addition to any rental or late fees already paid. The full retail value will be charged to the credit card on file if we do not hear back from the customer within five (5) business days of the rental period end. The Fitzroy reserves the right to pass on these charges to external collections agencies where necessary.

13.) Credit Card Authorization:
The renter authorizes The Fitzroy to keep a valid credit card securely on file and automatically charge it if necessary for any breach of the rental terms. This includes loss, theft, non-return, late return, or applicable additional fees. Any personal credit card information provided to The Fitzroy will be kept strictly confidential. Where a credit card is not held on file, The Fitzroy may place a hold as a security deposit, until all Rental Items have been returned, deducting any late fees as applicable.
